At Rewind Photo Services, we take the utmost care in handling your cherished memories. However, by using our services, you acknowledge and agree to the following terms regarding liability:
1. Handling and Damage Disclaimer
While we strive to handle all photographs, negatives, and documents with extreme care, Rewind Photo Services is not responsible for any damage that may occur during the scanning process. This includes but is not limited to warping, tearing, discoloration, or other unforeseen physical or digital damage.
2. Loss or Misplacement
Although rare, occasional human or mechanical error may result in a photo being misplaced. By submitting materials to us, you accept that Rewind Photo Services will not be held liable for lost or misplaced photographs or materials.
3. Natural Disasters and Unforeseen Events
Rewind Photo Services is not liable for loss or damage resulting from events outside of our control, including but not limited to fire, flood, earthquake, theft, power outages, hardware failure, or other acts of nature or third parties.
4. Storage and Return of Materials
While your materials are in our possession, they are stored securely. Once the scanning process is complete and the originals are returned or disposed of (as per client instructions), Rewind Photo Services no longer holds responsibility for them.
5. Digital Deliverables
We make every effort to ensure that digital copies are complete and of high quality. However, we do not guarantee the perfection or completeness of every file, especially in cases where original materials are faded, damaged, or difficult to scan.
6. Client Responsibility
Clients are responsible for properly labeling, organizing, and packaging items sent to us. Rewind Photo Services is not liable for damages caused by inadequate packaging or unclear labeling.
7. Limitation of Liability
To the fullest extent permitted by law, Rewind Photo Services’ liability shall be limited to the amount paid for the services provided. Under no circumstances shall we be held liable for incidental, consequential, indirect, or special damages, including emotional distress or loss of sentimental value.
